            Charges and Payment.Customer shall pay Dumpster Direct for the collection and disposal provided by Dumpster Direct including any dig out, blocked container and/or excess disposal charges levied, cancellation fee, trip charges or relocation charges that were not prepaid by Customer, in accordance with the schedule of charges.
 Each of the above fees will be charged to the credit card on file immediately after the specified service is provided.
 
 For all amounts billed and not paid in advance, Customer shall make payment within ten (10) days after the date of an invoice from Dumpster Direct. Dumpster Direct may impose, and Customer agrees to pay, a late fee no greater than that allowed by law on balances not paid within ten (10) days of the date of the invoice. In the event that any payment is not made when due, Dumpster Direct may, at his sole option, terminate services, recover all past due payments and recover any equipment from the premises. Company reserves the right to charge a fee no greater than that allowed by law on all Customer checks returned for insufficient funds.Waste Material.Customer represents and warrants that the materials placed in the equipment shall be “waste material” as defined herein and shall contain no other substances. The term "waste material" as used in these Terms and Conditions shall mean solid waste generated by Customer excluding radioactive, volatile, highly flammable, explosive, biomedical, infectious, toxic, or hazardous material. The term “hazardous material” shall include but not be limited to, any amount of waste listed or characterized as hazardous by the United States Environmental Protection Agency or any state agency pursuant to the Resource Conservation and Recovery Act of 1976, an enabled or applicable state law. Dumpster Direct shall acquire title to conforming waste material when it is located into Dumpster Direct trucks. Title to and liability for any waste excluded above shall remain with Customer and Customer expressly agrees to defend, indemnify and hold harmless Dumpster Direct from and against any and all damages, penalties, fines and liabilities resulting from or arising out of such waste excluded above.Driveways and Parking Areas.Customer warrants that any right of way provided by Customer for Dumpster Direct’s equipment is sufficient to bear the weight of all Dumpster Direct’s equipment and vehicles reasonably required to perform the service herein contracted. Dumpster Direct shall not be responsible for damage to any private driving surface, pavement or accompanying sub-surface of any route reasonably necessary to perform the service herein contracted and Customer assumes all liabilities for damage to driving surfaces, pavement or road surfaces and entire container placement site.Contamination.The inclusion of any materials not meant for the Equipment type as described may result in cost alteration. Any loads rejected by the landfill are subject to a contamination fee. The Customer is solely responsible for the Equipment’s contents. Unacceptable Materials.

This charge will be automatically applied to the credit card on file once we receive a weighing slip from the landfill. The charge receipt along with the weighing slip will be sent to you either by email or mail.Overfills and Offloads.The Customer is required to observe the fill line on the side of the Equipment. The Dumpster Direct will not haul Equipment with debris protruding from the top or Equipment that surpasses the weight restrictions for public roads and highways established by the Department of Transportation. In this event, the Customer is responsible for its offload and may incur a $115.00 attempted delivery/removal fee should the Dumpster Direct have to reschedule a time to return to remove the EquipmentActs of Mother Nature.Dumpster Direct is not responsible for excess weight due to acts of mother nature.Equipment Care.The equipment furnished hereunder by Dumpster Direct shall remain the property of Dumpster Direct, however, Customer acknowledges that it has care, custody and control of the equipment while at the Customer’s location and accepts responsibility for any loss or damage to the equipment (except for normal wear and tear or for loss or damage resulting from Dumpster Direct’s handling of the equipment) and for its contents. Customer agrees not to overload (by weight or volume), move or alter the equipment, and shall use the equipment only for its proper and intended purpose. Customer agrees to indemnify, defend and hold harmless Dumpster Direct against all claims, damages, suits, penalties, fines and liabilities for injury or death to persons or loss or damage to property arising out of Customer’s use, operation or possession of the equipment. Access.Customer agrees to provide unobstructed access to the equipment on the scheduled collection day. If the equipment is inaccessible so that the scheduled pick up cannot be made, Dumpster Direct will promptly notify the Customer and afford the Customer a reasonable opportunity to provide the access and reschedule the service, however, Dumpster Direct will charge an additional fee for Customer’s failure to provide initial access.Dumpster Rental Pricing.The Dumpsters or roll off container’s rental price keeps varying based on zip code of your service location. Pricing can differ by city, county and state. Dumpster rental pricing is subjected to change at any point of time until you book an order. Cancellations.Cancellations or changes made 24 hours prior to the scheduled service date are subject to a $50.00 cancellation fee. Cancellations made on the scheduled delivery date will be subject to a $125.00 cancellation fee. Delivery and Pick Up.Delivery and/or removal of the dumpster is at the discretion of the driver. Dumpsters are to be filled level with the top edge! If the driver is unable to make a delivery and/or removal due to safety, lack of accessibility, overloaded, or overweight the customer will be billed a $125 trip charge. Disclaimer.Due to uncertain soil conditions and sub surface terrain, Dumpster Direct cannot be held responsible for any damage to customer driveways, curbs, lawns or walks, wells and septic systems. It is the customer's responsibility to make Dumpster Direct aware of any underground utilities, which might be affected by taking delivery of the dumpster / container. Every effort will be made to deliver/pickup a container within 8 hours, 5 days a week. However, due to inclement weather, traffic conditions or mechanical breakdowns, delivery times or dates could vary. We will promptly contact you if there are delays in delivery or pickups. Excused Performance.Neither party hereto shall be liable for its failure to perform or delay performance hereunder due to circumstances or the significant threat of circumstances beyond its reasonable control, whether foreseeable or not, including, but not limited to strikes, labor trouble, riots, compliance with laws or government orders, acts of war or terrorism, inability to access container, fires, and acts of god and such failure shall not constitute a default under this Agreement.Attorney Fees.In the event of breach of the Agreement by either party, the breaching party shall pay all reasonable attorney’s fees and costs of the other party incident to any action brought to enforce this Agreement. In the event Customer fails to pay Dumpster Direct all amounts which become due under this Agreement, Customer agrees to pay, in addition to the amount due, any and all costs incurred by Dumpster Direct as a result of such failure to pay, and including to the extent permitted by law, reasonable attorney fees.Refunds. All refund, compensation, and/or credit requests must occur within 30 days of service completion. Any refunds issued will be at the sole discretion of Dumpster Direct.  |

No refunds will be given for removing the container earlier unless  extra day charges were previously incurred. |

            Waste Material – MUST DEFINE EACH  WASTE STREAM: Customer represents and warrants that the materials placed in the  Equipment shall be "Waste Material," as defined herein, and shall  contain no other substances. The term "Waste Material," as used  herein, shall mean: solid waste generated by Customer, excluding radioactive,  volatile, highly flammable, explosive, biomedical, infectious, toxic, or  Hazardous Material. The term "Hazardous Material" shall include any  and all hazardous material including, but not limited to, any amount of waste  listed or characterized as hazardous by the United States Environmental  Protection Agency or any state agency pursuant to the Resource Conservation and  Recovery Act of 1976 as amended or applicable by law. Regardless of the  circumstances, title to and liability for any waste excluded from the definition  of "waste material" set forth above ("Excluded Waste")  shall remain with the Customer, and the Customer expressly agrees to defend,  indemnify and hold harmless the Contractor from and against any and all  damages, penalties, fines and liabilities resulting from or arising out of such  Excluded Waste. Other items that are excluded from the term "Waste  Material" and are prohibited from being placed in the Equipment include,  and are not limited to, liquids, solvents, chemicals, Freon, batteries, paint  cans (unless dry), biohazards, medical waste, propane tanks, asbestos, lead  painted materials, dirt, equipment containing gas or oil. Restrictions and  additional fees may apply to appliances, furniture, refrigerators, freezers,  box springs, mattresses, air conditioners, tires, televisions, monitors and  computers (collectively, "Restricted Items"). The Customer is  required to contact the Contractor and inquire as to the nature and extent of  any restrictions and/or additional fees that may apply to Restricted Items prior  to placing said Restricted Items in the Equipment. |

            Charges and Capacity: The maximum tonnage  included in each package is listed under the "Service Charges"  category in the order description section of your order confirmation. You will  be charged for any excess tonnage (disposal above and beyond the tonnage  included in the contracted price) at the fees listed or stated in the order  description section of your order confirmation. In computing the tonnage of  Waste Material in the Equipment, the tonnage will be rounded up to the next  full ton. A state certified landfill ticket is available upon request. Any  additional charges and/or fees for excess tonnage and/or prohibited or  restricted materials (including Excluded Waste and Restricted Items) will be charged  automatically to your credit or debit card. In the event such additional  charges and/or fees are incurred, such charges and/or fees may appear on a  subsequent bank or credit card statement from the original charge. |

            Equipment Care: The Equipment  delivered to the Customer is the property of the Contractor who delivers the  same; therefore, the Customer will take reasonable care of it. Any damage,  movement, loss, or destruction of any Equipment is the responsibility of the  Customer and will be charged to the Customer. The Customer agrees that he/she  is responsible for any and all claims resulting from the use, placement, and/or  access to the Equipment and any and all damages, injuries, wrongful death,  suits, penalties and fines that arise there from; and the Customer hereby  agrees to indemnify the Contractor, The Home Depot and OAKLEAF Waste  Management, LLC, and any of said entities agents, affiliates, principals or  employees, from any and all such claims, damages, injuries, wrongful death,  suits, penalties and fines. It is the Customer's responsibility to ensure that  the Equipment is safe and secure until it is picked up by the Contractor.  Leaving the Equipment unattended shall not relieve the Customer from any  liability, charges for contamination, or additional disposal fees. |

            Delivery and/or Removal: Delivery and/or  removal of the Equipment is at the discretion of the Contractor and is based on  safety and accessibility. It is the Customer’s responsibility to make the  Contractor aware of any overhead wires, low hanging branches, narrow alley  ways, and/or any other such obstructions that may limit or prohibit access to  the location and/or Equipment. If the Contractor is unable to deliver and/or  remove due to safety and/or lack of accessibility, the Customer will be charged  a $100.00 attempted delivery/removal charge per occurrence. Any changes to the  order must be made by 2:00 p.m. local time the day before delivery or pick up  (Monday delivery or pick up changes must be requested by 2:00 p.m. local time  Friday). Deliveries and removals shall occur between the hours of 7:00 am and  7:00 pm. The Contractor does not offer and will not guarantee a service time  frame more specific than this 12 hour window. Furthermore, the time of day the  Equipment is delivered will have no correlation on the time of day the  Equipment is removed. |

            Driveways and Parking Areas: The Customer  covenants, represents, and warrants that any access/location provided for the  Contractor's Equipment is sufficient to bear the weight of all Equipment and  vehicles required to perform the service. The Contractor shall not be  responsible for damage to any pavement or accompanying sub-surface or any route  reasonably necessary to perform the services herein contracted. In addition,  the Contractor shall not be responsible for damages to pavement, utilities,  property, lawns, fences, shrubbery or other like exterior items. |

            Placement and Street Permits: Should the Customer  request the Contractor return to the site to move or reposition the Equipment  during the rental period, the Customer will be charged a $100.00 relocation fee  per occurrence. In the event that the Equipment is placed in the street for the  duration of the rental period per the Customer’s request or due to a lack of  off-street access, the Customer may be responsible for obtaining a street  permit from the city or may be subject to a street permit fee from the  Contractor. |

            Weather We recommend covering  the Equipment with a tarp to keep out rain and snow. Rain and snow may add  substantial weight to the total tonnage, which the Customer is responsible for.  In the event the Customer does not tarp the Equipment while in his/her charge  and ice, snow, sleet, and/or freezing conditions causes any substantial amount  of debris to become frozen to the Equipment, the Customer will be subject to a  $50.00 dig out service fee. |

            Reasonable control: OAKLEAF and its  Contractors warrant that they will make every effort to deliver and pick up as  directed under contract. They are not liable for forces of nature, strikes,  laws, inhibited access, etc. that are beyond their control. |

            Refunds: All refund,  compensation, and/or credit requests must occur within 30 days of service  completion. Any refunds issued will be at the sole discretion of OAKLEAF. |

            Damage Claims: All claims of damage  caused by OAKLEAF Waste Management, LLC ("OAKLEAF") and its  Contractors must be communicated within 48 hours of the removal of the  Equipment from the location. The Customer hereby waives any and all right to  assert a claim against OAKLEAF in the event it fails to provide timely notice  under this section.  |
